(b) “State, county or municipal agency or political subdivision, as defined in Section 491.023(b), “the commissioner of special services under Chapter 44 of Title 44 of the Texas Code of Criminal Justice,” or “the department of insurance or the department of transportation,” can request the production of a taxpayer's records, including all of a taxpayer's records. (c) “Electronic” records includes, but is not limited to, computerized systems and databases or databases electronically searchable by names or other terms. (d) “State or local law enforcement agency” can request the production of a taxpayer's records by electronic means, without limitation, or by manual or electronic means. (f) Electronic records may be produced in any format. The commissioner of special services or the department of administration may, at its own cost, establish and maintain a database for the identification of taxpayers and for the production of information from or about the taxpayer in connection with an information request relating to a law enforcement activity, including but not limited to the establishment and maintenance of tax databases; the establishment and maintenance of criminal databases; the production, by electronic means, of a record and its location within such databases in a uniform format. An electronic record shall be subject to audit by the commissioner of special services on an annual basis, pursuant to Section 903.032.(a)-(b). The electronic record shall be considered a taxpayer's record for the purposes of tax audits as provided for in Sections 903.061-903.063.
